Municipal Prosecutor Responsible for conducting prosecutions and appeals in the Ontario Court of Justice for offences under provincial statutes, selected federal statutes and municipal by‑laws.General DutiesConduct prosecutions (first attendance, pre‑trials, trials, pre‑appeals, appeals) by evaluating charges, reviewing evidence, determining appropriate actions and preparing legal documents.Conduct disclosures, respond to motions under the Canadian Charter of Rights and Freedoms and other pre‑trial proceedings.Review statements of witnesses, interview and prepare expert and civilian witnesses.Prepare and direct the preparation/serving of related court documents.Negotiate settlements when required.Present oral and written legal arguments in the Ontario Court of Justice.Provide advice and guidance to law enforcement officials, members of the legal profession, Ministry officials, the general public, Justices of the Peace and City staff.Engage in resolution discussions with opposing counsel, agents and members of the public on complex sensitive matters.Conduct extensive research, analyze case law, compose technical legal documents and correspondence.Act as liaison with POA court services and collections financial staff; manage collection claims before Small Claims Court.Notify supervisor of matters raising substantive legal issues or application for judicial review.Recommend changes to policies related to prosecution activities.Respond to inquiries from public, enforcement agencies and municipal staff concerning prosecutions.Provide searches of title, subsearches, approval of forms and registration of documentation for enforcement departments.Assist enforcement staff with instruction, design and conduct educational seminars on evidence collection and court procedure.Occasionally travel outside jurisdiction to prosecute offences requiring an out‑of‑town prosecutor.Train, supervise, and assign work to co‑op students and legal assistants.Work in accordance with Occupational Health and Safety legislation and City policies.Perform other duties directly related to responsibilities of the position.QualificationsProven knowledge in theory and practice of law, advocacy, selected federal and provincial statutes, municipal by‑laws and appeals normally acquired through a diploma in a Court and Tribunal Agent Program and/or Paralegal Program or equivalent education/experience. Additional 2–3 years prosecution experience preferred.Familiarity with enforcement agency investigation techniques.Strong verbal, written and presentation skills.Strong interpersonal skills and ability to be diplomatic.Excellent organizational and analytical skills.Experience in a computerized environment with Microsoft Office, ICON, DEMS, Teraview.Ability to comply with Memorandum of Understanding prosecutorial standards set by the Province of Ontario.Ability to travel within the City of Hamilton and neighbouring municipalities; valid Ontario Driver’s Licence an asset.Fluency in French in courtroom setting is an asset.The City is an equal opportunity employer committed to inclusive, barrier‑free recruitment and selection processes.
